Put this clause in your agreement states that if the firm renting our list uses it again without list rental agreement authorization, they "agree to pay all court costs and attorneys fees" if we sue them and they lose in court. List renters sign it before we send them the list.

 

To prevent additional uses from a one-time rental, list owners and managers seed the list with names of friends and family members, and insert special spellings and codes to make sure their list isn't used again without authorization. It's difficult to prosecute offenders in states other than where your office is, but I don't recommend using a list more times than you have paid for. It's stealing.

 

When you rent out your own list of names, if you don't have this phrase in your list rental contract (even if you win a court case from someone using your list twice) you can still collect the additional rental fees you're entitled to. But you're still without compensation for the aggravation, and costs of your attorneys. If you have this clause in your contract and you win, at least you get your court costs back, and the other party has to pay your attorney for the privilege of being sued by him. If you can collect. Ugh.

 

When you rent a list, it is generally rented for one-time use. Unless you contract for multiple uses (and pay more for this privilege) you only get one shot to mail to these names, make it a good one.
